GENERAL PROVISIONS OF THE GENERAL TERMS AND CONDITIONS OF SALE
1. Subject
These General Terms and Conditions of Sale (GTCS) govern the sale of items available on the ARTS ANCIENS website as well as purchases made in direct sales.
The Customer is clearly informed and acknowledges that these GTCS apply to any order placed on the website https://staging.limage-et-le-livre.com/ for the purchase of an item throughout the transaction and shipping of the items.
These transactions carried out via the ARTS ANCIENS – L’Image et le Livre website or through direct sales at its store L’Image et le Livre are an integral part of the contract between the Customer and the company ARTS ANCIENS, the seller.
It is strongly recommended to read the following General Terms before placing an order or making a purchase.
2. Modification and Acceptance of GTCS
The company ARTS ANCIENS reserves the right to modify its GTCS at any time. In case of modification of the GTCS, the modifications are, however, only enforceable against the Customers from the moment they are put online and can in no way apply to contracts concluded prior to the modifications. The applicable GTCS are those in force on the date of the order.
The Customer undertakes to carefully read these GTCS and accept them before proceeding to the payment of an order placed on the ARTS ANCIENS website. By placing an order on the website, the Customer unreservedly accepts these GTCS and waives any contrary clause, even those appearing in the Customer’s general terms and conditions of purchase.
3. Product Offer
Each item for sale is described on the ARTS ANCIENS website by clicking on each item. This description mentions the essential characteristics of the item.
The described books are complete and in good condition unless otherwise stated.
We provide engravings with a certificate of authenticity. We do not sell recent reproductions.
In case of unavailability of an item, ARTS ANCIENS will inform the Customer immediately by email.
4. Order / Conclusion of the Contract
The information stated by the buyer at the time of placing an order binds the buyer; in the event of an error in the recipient’s address details, ARTS ANCIENS cannot be held responsible for the inability to deliver the item.
To place an order, the Customer, after filling their virtual cart with the selected products, then clicks on the “Order” button and provides the information relating to their identification, delivery, and payment method.
The Customer is required to provide all accurate and necessary information for their order.
Before clicking on the “Order” button, the Customer has the opportunity to verify the details of their order and its total price, download the GTCS, and return to previous pages to correct any errors or potentially modify their order if they wish.
After confirming the content of their order, the Customer will finalize it by payment. The order will only be final upon full payment of the corresponding price.
An email acknowledging receipt of the order and payment will be sent by ARTS ANCIENS without delay. After concluding the contract and at the latest upon delivery, the Customer will receive a confirmation email of their order detailing the items ordered, the price (expressed in euros), the delivery fees, the order number, and the GTCS.
Any modification of the order by the Customer after confirming their order is subject to the acceptance of ARTS ANCIENS.
The archiving of communications, order confirmations, and invoices is carried out on a reliable and durable medium to constitute a faithful and durable copy in accordance with Article 1348 of the Civil Code. These communications, order confirmations, and invoices may be produced as evidence of the contract.
5. Price and Payment Methods
The sale prices are indicated in euros and net. They do not include delivery and insurance costs, which are the responsibility of the Customer. The total amount due by the Buyer, including the sale prices of the products and delivery fees, is communicated to the Customer before they place their order.
In case of a promotion, ARTS ANCIENS agrees to apply the promotional price to any order placed during the promotion period. The proposed rates include the discounts and rebates that ARTS ANCIENS may grant.
The company ARTS ANCIENS reserves the right to change its rates at any time. However, it undertakes to invoice the goods ordered at the prices indicated at the time of recording the order. In the event of a manifest typographical error in the sale price of a product, ARTS ANCIENS will inform the Customer of the said error as soon as possible and cancel the order of said product.
The price is payable in cash and in full on the day of placing the order. Payment for the order is made immediately by bank card (CB Visa, American Express, or Mastercard). Payment by bank card is made via the secure site. This site is registered with 3D SECURE security. All bank charges generated by the purchase made on the site and not attributable to ARTS ANCIENS (e.g., cancellation fees, payment refusal fees, exceeding the authorized payment limit, etc.) are the responsibility of the Customer.
In the event of non-payment or refusal to authorize payment of the order by accredited bodies, ARTS ANCIENS will refuse the order.
In addition to the provisions, the online provision of the bank card number and the final validation of the order will constitute proof of the entirety of said order in accordance with the provisions of the law of March 13, 2000, and will constitute payment of the amounts incurred by the selection of items appearing on the order form. This validation is equivalent to a signature and express acceptance of all operations carried out on the ARTS ANCIENS website.
Since the price is payable in cash, the provisions of Article L.441-6 of the Commercial Code relating to payment deadlines, applicable late payment penalties (conditions of application, interest rate), and fixed compensation do not apply.
6. Discount
No discount will be granted in case of advance payment.
7. Right of Withdrawal
In distance selling, you have a withdrawal period of 14 days if your purchase does not meet your expectations or is not as described, with shipping costs remaining at your expense.
The consumer benefits from a right of withdrawal under the following conditions, provided that the consumer is a natural person who concludes a legal act for personal purposes and that this act cannot be attributed to either their commercial activity or their independent professional activity:
In accordance with the provisions of Article L121-20-12 of the Consumer Code, the Customer has a period of fourteen (14) days from the day of receipt of the ordered product to exercise their right of withdrawal, without having to justify any reason or pay penalties, except for the return costs. Any products that are incomplete, damaged, or soiled will not be taken back and will not be refunded.
The withdrawal period is 14 days from the date on which the Customer or a third party designated by them, who is not the carrier, took possession of the ordered items.

using a statement informing ARTS ANCIENS of your decision to cancel this contract. The deadline is deemed to be met if the Customer transmits their decision regarding the exercise of the right of withdrawal before the withdrawal period expires.
If the Customer revokes the contract, ARTS ANCIENS will refund all payments received from the Customer, including shipping costs (except for increased costs due to a different and more expensive delivery service chosen than that which ARTS ANCIENS offers as standard) as soon as possible and at the latest within two weeks from the date on which ARTS ANCIENS received notification of the Customer’s withdrawal. ARTS ANCIENS will use the same payment method for this refund that the Customer used for the initial transaction unless another method has been agreed upon with the Customer; no fees will be charged for this refund.
ARTS ANCIENS may withhold the refund until receipt of the returned item or upon receipt of proof that the goods have indeed been returned, whichever date is earlier.
The merchandise must have been reshipped within 30 days, in its original condition.
End of right of withdrawal: For information, the right of withdrawal does not apply outside the European Union (except Switzerland and Liechtenstein).
8. Retention of Title Clause
The company ARTS ANCIENS retains ownership of the goods sold until full payment of the price, principal, and accessories. As such, if the buyer is subject to receivership or liquidation, the company ARTS ANCIENS reserves the right to claim, within the framework of the collective procedure, the goods sold and remained unpaid.
9. Delivery
Whenever possible, orders are shipped within 48 hours of receipt of payment, at the latest within 7 days.
Products are delivered to the address indicated by the Customer when placing the order. The Customer is required to provide all accurate and necessary information for delivery: exact address, access code, phone number where the Customer can be reached. In the absence of necessary information for delivery, the order may be canceled by the company ARTS ANCIENS.
For the perfect information of the Customer, the costs associated with the different delivery methods used by ARTS ANCIENS are indicated on a dedicated page of the site.
However, the company ARTS ANCIENS will not be liable in case of loss or damage of the product attributable either to the Customer or to an unforeseeable and insurmountable fact of a third party to the contract designated by the Customer and other than the carrier proposed by ARTS ANCIENS.
10. Reservation of Ownership
The transfer of ownership of delivered items is subject to full payment of the price and its accessories.
11. Intellectual Property
The elements reproduced on the Site, whether visual or auditory, are the exclusive property of the publisher and are protected by copyright, trademark law, and patent law.
Any reproduction and dissemination of these elements, without prior written authorization from the publisher, expose offenders to legal proceedings.
12. Personal Data
The personal data collected is intended solely for the company. It is subject to computer processing necessary for the processing of the order and the management of relations with the Buyer.
In accordance with law n° 78-17 of January 6, 1978, as amended, the Customer has at any time the right to oppose, access, modify, rectify, and delete personal data concerning them.
The company ARTS ANCIENS may directly use this personal data during marketing operations relating to similar products. The Customer can oppose the use of their personal data for marketing purposes, either at the time of collection or later by writing to ARTS ANCIENS.
13. Force Majeure
The responsibility of the company ARTS ANCIENS cannot be implemented if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale results from a case of force majeure. As such, force majeure means any external, unforeseeable, and irresistible event within the meaning of Article 1148 of the Civil Code.
14. Applicable Law and Jurisdiction
Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law.
In the absence of an amicable resolution, the dispute will be brought before the Commercial Court of Strasbourg.
